Terms of Service

Purpose

Thank you for using the products, websites, and services provided by Yuki Tanaike (the 'Author') (collectively, the 'Service').
By using the Service, users (the 'Users') agree to these Terms.

About These Terms

The Author may change these Terms without obtaining prior consent from Users, and Users are deemed to have accepted such changes.

Use of Personal Information

In providing the Service, the Author may use Users' personal information in accordance with the separately established Privacy Policy.

Copyright

Copyrights and intellectual property rights related to information provided by the Author through the Service belong to the Author or third parties who have legitimate rights to such information.
Users may not quote, reproduce, or copy content provided by the Author for purposes other than private use.

Service Restrictions and Deregistration

The Author may, without prior notice, restrict Users from using all or part of the Service or deregister a User in the following cases.

1. If any provision of these Terms is violated
2. If the User engages in conduct that interferes with or may interfere with operation of the Service
3. If the User engages in conduct that disadvantages other Users or third parties
4. If the Author otherwise determines that the User's use of the Service is inappropriate

Changes to or Termination of the Service

The Author continuously works to improve the Service. The Author may add, modify, or delete features, or suspend or terminate the entire Service, without notice to Users.

Disclaimer and Liability

1. The Author makes no warranties of any kind regarding the accuracy, legality, or any other aspect of information provided through the Service. Furthermore, the Author makes no warranties regarding information that Users obtain directly or indirectly from the Service.
2. The Author shall not be liable for any damages incurred by Users or third parties in connection with changes, interruption, suspension, discontinuation, or termination of the Service, or otherwise related thereto.
3. If a User causes damage to the Author through conduct that violates these Terms or through improper or illegal acts, the Author may claim appropriate compensation for damages from that User.

About Links

The Service may contain links or banners that lead to other websites, but the Author is not responsible for the content of linked sites.

Governing Law

These Terms shall be interpreted and applied in accordance with the laws of Japan.

Jurisdiction

In the event that litigation becomes necessary in connection with the use of the Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.

Privacy Policy

Introduction

The Author establishes this Privacy Policy (the 'Policy') as set forth below regarding the handling of privacy information in the Service.

Personal Information

In this Policy, 'personal information' means 'personal information' as defined by the Act on the Protection of Personal Information, and refers to information about a living individual that can identify a specific individual by name, date of birth, or other description contained in such information.

Information We Collect

In order to use the Service, the Author may ask Users for personal information such as name and email address. The Author may also collect Users' personal information from the Author's business partners (including information providers, advertisers, ad delivery partners, and others; hereinafter referred to as 'Partners') regarding Users' personal information exchanged between Users and Partners, etc.

The Author may collect log information when Users use the Service. Log information includes records and characteristic information such as the services or software used by Users, pages viewed, advertising history, search keywords, date and time of use, method of use, usage environment (including communication status of mobile devices and various settings when using mobile devices), IP address, cookie information, location information, and device identifiers, which are collected when Users use the services of the Author or Partners or browse pages.

About Cookies

The Service may collect information through cookies for the purpose of enriching content and operating the Service stably. Cookies are stored on the User's computer when the User visits the site.

If Users do not wish to have information collected through cookies, they can configure their browser settings to refuse cookies. Please note that some content or services may not function properly in that case.

Use of AI Services

For its AI generation features, the Service sends the text entered and submitted by Users to the OpenAI API to generate content.

The information sent is limited to the following.

• Text entered by the User on the generation screen and submitted using the send button

The Service does not intentionally add the User's name, email address, contacts, location information, advertising identifier, or device identifier to the text sent to OpenAI. However, if the text entered by the User contains personal or confidential information, that information will also be sent to OpenAI.

The information is used only to generate the content requested by the User.

The OpenAI API is provided by OpenAI. Information sent to the OpenAI API is processed in accordance with OpenAI's data handling terms and privacy safeguards. The Author confirms that OpenAI provides the same or equivalent protection of User data as described in this Policy.

Users can decline to send text to OpenAI by not using the AI generation features.

Use of Personal Information

The purposes for which the Author collects and uses personal information are as follows.

1. To provide, maintain, protect, and improve the Service, to develop new services, and to protect the Author and Users
2. To provide content tailored to customers by the Author
3. To analyze and improve Users' experience and the overall quality of the Author's services
4. To enable the Author to verify Users, such as when responding to inquiries from Users
5. For purposes incidental to the above purposes of use

Third-Party Provision of Personal Information

• Except as permitted by the Act on the Protection of Personal Information and other laws and regulations, the Author will not provide personal information to third parties without prior consent of Users. However, in the following cases, the Author may access personal information and disclose it to third parties.
  1. When required by law
  2. When the consent of the individual concerned has been obtained
  3. When necessary to protect the life, body, or property of a person and it is difficult to obtain the consent of the individual concerned
  4. When especially necessary to improve public health or promote the sound growth of children and it is difficult to obtain the consent of the individual concerned
  5. When it is necessary to cooperate with a national government agency, a local government, or a person commissioned by them in performing duties prescribed by laws and regulations, and obtaining the consent of the individual concerned may impede the performance of those duties
• Notwithstanding the provisions of the preceding paragraph, the following cases shall not constitute provision to a third party.
  1. When the Author outsources all or part of the handling of personal information within the scope necessary to achieve the purpose of use
  2. When personal information is provided as a result of business succession due to merger or other reasons
  3. When personal information is jointly used with a specific party, and the fact of such joint use, the items of personal information to be jointly used, the scope of the parties using the information, the purpose of use of those parties, and the name of the person responsible for managing the relevant personal information are notified to the individual in advance or made readily accessible to the individual

Disclosure of Personal Information

When requested by the individual, the Author will disclose personal information to that individual. However, the Author may not be able to comply with a request if it does not satisfy the requirements under the Act on the Protection of Personal Information or other laws and regulations, or if there are grounds on which disclosure may be refused. If the Author incurs costs in making a disclosure, a handling fee may be charged.

As a general rule, information other than personal information, such as history information and characteristic information, will not be disclosed.

Changes

• The contents of this Policy may be changed without notifying Users.
• Unless otherwise specified by the Author, the revised Privacy Policy shall become effective when posted on this website.
